These terms of use ("Terms") govern your access to and use of polyswiss.ch (the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.
The service
polyswiss is a virtual prediction market. You trade virtual shares on the outcomes of curated markets; shares on the outcome that happens are redeemed for coins and the rest expire worthless. The Service is provided for entertainment as a social game.
Virtual coins — no real money
Virtual coins are granted to you free of charge, including a one-time signup bonus and amounts subject to a daily cap. Coins have no monetary value. They cannot be purchased, sold, transferred between accounts, redeemed, or exchanged for money, goods or prizes. We may grant, adjust, withhold or reset coin balances at our discretion, for example to correct errors or prevent abuse. Because no real-money stake is possible, the Service is a social game and not a money game (gambling) within the meaning of the Swiss Federal Act on Gambling (BGS).
Eligibility and account
You must register with a valid email address and verify it to use core features. You are responsible for keeping your login credentials confidential and for all activity under your account. You may hold only one account, and you must provide accurate information.
Acceptable use
You agree not to misuse the Service. In particular, you must not create multiple accounts, use bots or automated scripts, exploit bugs, manipulate markets, or otherwise interfere with the integrity of the game or other users' experience.
Markets and resolution
Markets are created, curated and resolved by polyswiss based on the outcome source identified for each market. Each outcome trades as shares that are redeemed for a fixed amount of coins if that outcome occurs and nothing otherwise, with trades matched between players and no operator cut. Where a market is created or resolved in error, is ambiguous, or its outcome cannot be determined, we may void the market and refund what players paid in. Our resolution decisions are final.
Availability and changes
We may modify, suspend or discontinue all or part of the Service at any time, and we may change these Terms. We provide the Service "as is" and do not guarantee that it will be uninterrupted or error-free.
Intellectual property
The Service, including its content, design and trademarks, is protected by intellectual property rights and remains the property of the operator or its licensors. You may use the Service only for its intended personal, non-commercial purpose.
Suspension and termination
We may suspend or terminate your account if you breach these Terms or misuse the Service. You may stop using the Service and request deletion of your account at any time.
No advice; disclaimers
Markets, outcomes and statistics are provided for entertainment only and do not constitute financial, investment, legal or other advice. The Service is not a betting or gambling service.
Limitation of liability
To the fullest extent permitted by Swiss law, we exclude liability for slight negligence and for indirect or consequential damages arising from your use of the Service. Mandatory statutory liability, including for unlawful intent and gross negligence, remains unaffected.
Data protection
We process your personal data as described in our Privacy Policy, which forms part of these Terms.
Governing law and jurisdiction
These Terms are governed by Swiss law, excluding its conflict-of-law rules and the United Nations Convention on Contracts for the International Sale of Goods. The exclusive place of jurisdiction is the registered seat of the operator, subject to any mandatory place of jurisdiction provided for consumers by law.
